The situation is getting more and more tense, as the whole gambling industry holds it’s breath in anticipation of the Kentucky judges’ decision. The first judge’s decision which approved the confiscation of international domain names has sprout many controversies and received a strong international criticism from Internet gambling industry and Net Neutrality agreements advocates. Thanks to a public protest and actions taken by the Interactive Media Entertainment and Gaming Association (iMEGA), three Kentucky judges from the Court of Appeals are now analyzing the previous judge’s decision.

To most of the observers, the outcome of the first trial was a real surprise. Not many have suspected that the judge will pronounce in favor of the State government and will approve the seizure of 141 domain names which are a property of international online casinos, information portals and other similar websites. The case is very serious in it’s consequences, as the agreement on confiscating the internationally registered domains would without doubt lead to a form of a Internet warfare and change the face of the World Wide Web forever. Currently every country has power over its assigned domains – violating this rule would lead to a series of diplomatic issues and would plunge the World Wide Web into Chaos.

The three Kentucky judges have made themselves familiar with all the information on which the previous judge has based his decision, as well as with some additional statements and briefings prepared by companies connected to the case. It is impossible to predict at this point how the whole process will end, but if the Kentucky Court sustains the previous decision some online gambling companies will be in serious trouble, as not only their presence on the US market will be in danger, but their international presence on the Internet too.

Despite recent success of the mobile and online casino gambling companies there is also possibility of slip and going down ever in this industry. A tiny thread of the puzzle may slip through the cracks and that is enough to force companies to close. The recent not so happy news comes from the Canada, where Phantom Fiber gambling company has to announce completely closure, there is no hope since all of the employees have been dismissed. Over the past several months were some small indications that problems of the Phantom are serious. When the weekly reports have been released, Jeff Halloran, the company’s CEO admits that the company known from the wireless mobile technology software developing and providing was running out of cash to operate.

At the end of November, the company announce closure to the whole of the mobile and online casino gambling industry. As the reason of closure, Phantom Fiber announced inability to make instalment payments to pay off debts. They cannot find the way of investments or loans to get the money needed to pay off the regularly payment installation. After some time, the company gave up and announced its closure.

The company terminated all of its employees, what of course wasn’t good news for them if considering these days’ economics. There were a lot of opinions that the current economy failing cannot harm the online casinos and gambling sites, because everyone still wants to gamble when there luck is down right? Well, the latest events show something completely different, that the mobile and online gambling industry is not untouchable.

Since the one major market is closed and the others are only slowly opening, the competition in the online casino gambling market becomes really tough in the latest years. While the US market is closed, companies like Sportingbet and others are trying to learn how to exist on the European and Asian markets, completely new for them. However, according to the recent news from Sportingbet, the company is lifting the net gaming revenue and pre-tax profits for the first quarter.

In the past few years a lot of new online casinos and sportsbetting sites have tried to find them in the market, however companies like Sportingbet are gaining experience how to run on these new markets with their creative campaigns and special offers. According to the Q1 report that has been recently released, the company noted 28 percent rise in the company’s online gaming profits. What’s more, pre-tax revenue was also nice at GBP 4,9 million.

In days when the online casino gambling industry is spreading and profitable business over the past year, according to Andrew McIver, Sportingbet’s CEO, it is a little different with sportsbetting industry: “Whilst sports betting has historically shown itself to be ‘recession hardy’, no industry is ‘recession proof’. Unfortunately there is also no empirical data with regard to the online casino and poker industry to estimate what the impact of an economic downturn may or may not be on these products.”

There is no clue how long the troubling economic situation may last since the recession in the US has been confirmed, however Sportingbet are trying to survive this storm by tightening up parts of the company.

It is certainly good news for the international online casino gambling operators, the Spain online gambling market is becoming more open for them. In the Spain, each region has separate gambling law including all forms of land based and online gambling. However, since Castilla y Leon region of Spain announced that they are going to regulate private sector of online gambling, the online casinos’ operators should be pleased and making plans for future concerning Spain. These days’ biggest sectors of the internet gambling market in Spain are mobile gaming and internet bingo, but there is a place for online gambling sector to be expanded as the more favourable legislation will come.

Latest news says that the Castilla y Leon region is waiting on Congress approval of new legislation which regulates industry as well as the licensing process. Once that will pass, there will not take long time for foreign companies to come on the Spanish market with their fancy offers developed especially for their Spanish customers. Representatives of the main group of the online casinos that will be trying to get onto the Spanish market have begun to help Congress finding a regulations and restrictions which will be the best for the Spanish market.

There are a lot of things that should be prepared and regulated while Spain enters the online casino gambling market, the major ones are: player safety, limits set on prizes and gambling in the region. Of course, each online casino that would like to operate in the Castilla u Leon region will have to fulfil set of requirements prepared by the Congress.

The recent rumour which claims that the online casino gambling companies are thinking about entering into countries that currently operate state-run monopolies, although companies deny such rumours it may be not as bad idea as the state monopolies gives better funding for the sports industry. Recently Sportsbusiness, a UK consultancy company had made a study designed as a comparative analysis of the UK and French land based and online casino gambling business. It investigated the case regarding gambling markets and sports funding provided by the country.

What’s quite interesting, the study shows that the main argument for leaving the land based and online casino gambling monopolies within the UK could be not as strong as it was. If you take a closer look at the two markets, first – the French market operated with state land and lottery monopoly on all forms of legalized gambling and the second – the UK market where we see highly regulated gambling market with taxes from all of the land and online casinos that are running on the market are partly used to fund sports, it is really obvious the better one.

When you set up the facts, statistics and numbers, it must be admit that UK does a really good job in the field of providing sports funding. Of course, there were spots where the French market gave the better outcome, but at the same time the UK model has better sports funding through taxes on the online casino and gambling companies. The report may be differently interpreted by different analyst, however it made a good point that it looks like monopolies are actually no better than regulated markets if you consider sports funding.
